1. General 

You can complete the contract of sale ind English or German language.

Set out below are the terms and conditions, which represent all the terms and conditions on which we will provide you with: (i) access to our website (located at www.magic-and-arts.com the products and services we offer from time to time via our Website; and (iii) any orders for our products which you may place from time to time (together referred to in this document as the Terms).  Your use of the Website, and/or your placing of an order through it, indicates your acceptance to be bound by the Terms.  If you do not agree to be bound by the Terms, please cease using this Website.

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

2. Offer, sales contract and supply

Offers are non-binding.  We take reasonable steps in the preparation and maintenance of this Website to ensure that all prices quoted are correct at the time when they are published, and that the descriptions of our products and any claims we make with respect to our service are fair and accurate.  We do, however, reserve the right to decline any order where there has clearly been a material error, or where there is an inaccuracy or omission in the price and/or description of any of our products as displayed or advertised on the Website (and we hereby exclude all liability arising from the same).

Postage and packaging costs are charged to the buyer.

Orders are confirmed by Magic and Arts by email, making the contract of sale valid.

Some items offered are one-off pieces, prices for which are subject to prior sale.

You will be informed immediately if any items ordered are no longer available.

Orders will be executed on a first come first served basis.

We have made every reasonable effort to reproduce colours on the Website as accurately as possible. However, different computers reproduce colours slightly differently and we therefore cannot and do not guarantee that the on-screen colours of any of our products will exactly match the colour of the product itself. You are advised, therefore, to treat on-screen colours as being indicative only of the actual colour of our products.

3. Delivery 

We will execute your order as soon as we have received your payment. Magic and Arts will only be liable for possible delays in delivery through gross negligence on our part. Delivery delay due to inevitable events or acts of God e.g. strike, lockout or other losses of the supplier might extend the estimated delivery time. If any of the afore-mentioned events occur, making delivery impossible, we are entitled to withdraw totally or partly from the sales contract. If it is impossible for Magic and Arts to fulfil a contract because of any such event as described above after one month or longer, it is the customer's right to withdraw from the sales contract. The customer has no other formal rights apart from those stated.

4. Price

All prices stated include legal VAT, which will be shown on your invoice. We accept Visa and Master Card  via Moneybookers and Paypal, as well as standard Bank Transfer. We will inform you about the exact amount due at the point of order confirmation. The buyer has the legal right to cancel their order within two working days after having placed the order. This cancellation has to be made by email.

Please note that, in addition to delivery charges, customs duty may have to be charged by us, depending on your country's regulations. This duty will be included in the final amount due.

All goods supplied by us remain our property until all outstanding payments are made in full. Liabilty for all goods delivered will be transferred to the customer after delivery. If any goods delivered are not accepted by the customer despite having been sent an order confirmation and not having cancelled the same within two working days, the customer carries all freight and delivery costs.

Delivery

Your order will be delivered after full payment of the amount due by bank transfer, paypal, credit card or after receipt of an invoice (this option is available at our discretion only). Delivery will be made within one to two working days after receipt of payment. In the unlikely event of delivery delays we will inform the customer.

Warranty/Returns

If any goods delivered are faulty, we will replace those like-for-like. The customer has no further legal rights, unless Magic and Arts have failed twice after the original delivery to send items to the customer's satisfaction, in which case it is the customer's right to cancel their sales contract with us.

5. Returns

It is the customer's right to return goods within 7 working days following the day of receipt for a full refund of all charges other than postage. If you would like to returnanything to us please inform us in writing (email, fax or mail) prior to sending the items in question back to us. Goods must be returned in new and unused condition. The cost and safe return of the goods is the responsibility of the customer. You are advised to send items by recorded delivery and obtain proof of postage from the post office. We are not responsible for the loss of any items during transit for any returned items.

Please note that made-to-order items cannot be returned.

6. Privacy Policy

We will use your personal data only in connection with your order.It is your right anytime to be informed about your data on file without any charge. If you would like to have your personal data amended or removed, please let us know by emailing service[at]magic-and-arts.com. We will neverpass your information on to third completion of your order, ie post office, DHL, UPS as well as Postbank, Eprompt, Wirecard, Paypal and Moneybookers. However, these partners will only be informed about the data they need to successfully complete their part of the order.

We use SSL encryption in our shop to protect ourselves against any access to your data contain any personal data.

All order information can only be seen in a special customer area only, and is kept safe in accordance with our data protection policy.

7. Credit Cards

The invoice amount charged will be shown on your credit card statement as Magic and Arts / Moers. Your personal data will be encrypted (SSL encryption) during transfer from the internet, and for your (and our) security your credit card information will be deleted from our system after payment is complete. The amount due will be charged on the day your order is dispatched. You will receive an order confirmation, as well as shipping information, by email. We aim to dispatch your item(s) within two business days. Please keep your order confirmation for your records. As a registered customer, you also have the option to check your order history in your account. If you would like to see your history, please log in to your account and select your account at the top of the page.

Please note that if you decide to cancel your credit card payment (chargeback) our credit card partner will charge a fee of  39,00 Euro. Please consult Magic and Arts before you do so.

8. Google Analytics: Notice for visitors to the website 

Magic and Arts's online shop is using Google Analytics, an internet analysis service of Google Inc. (Google), which is using cookies, ie small text files which are saved on your computer and are used to Website will be saved via this Google-Analytics-Cookie (including your IP-address) and sent to Google's server in the US. Google will then be able to analyse the use of our website in terms of visitor activity etc, which is important for us as a shop so we can continuously improve our service. If legally necessary, Google will pass this information on to third parties. However, Google does not know your name or address, and will not match your IP-address with other data it might know. You have the option of banning the use of cookies in your browser, however, please note that you might then not be able to use all available functions of our Website.

Your use of this Website indicates your acceptance of your data to be used by Google for analysis purposes as described above.

9. Bonus Points

Magic and Arts offer a bonus points scheme. Please note that this scheme is a voluntary service by us. The customer has no legal rights in connection with bonus points.

Bonus points are granted as per the following chart:

• 30 points for orders from 10 EUROs
• 60 points for orders from 20 EUROs 
• 150 points for orders from 50 EUROs 
• 300 points for orders from 100 EUROs 
• 450 points for orders from 150 EUROs 
• 600 points for orders from 200 EUROs

We have used reasonable care and skill in compiling the content of this site and we accept no responsibility or liability for any inaccuracy, errors and omissions. This includes certain (hypertext) links on the Website which may lead to sites operated by third parties which are not under our control. When you activate any such links you will leave the Website. We therefore accept no responsibility or liability whatsoever for any of the content, products and/or services (including any hypertext links to further websites) that may be included, advertised or sold on such third party websites.

We reserve the right to modify or withdraw (temporarily or otherwise) this Website or modify these Terms from time to time without giving you prior notice. It is your responsibility to read these Terms on each occasion you use the Website. Your continued use of this Website shall signify your acceptance to be bound by the latest Terms. We also accept no responsibility or liability for any damage or injury to persons or property arisingfrom the use of any instructions.The application of the 1980 Vienna Sales Convention on Contracts for the International Sales of Goods (CISG) is excluded.
